Environmental Legal Register
Procedure to develop the Corporate Register

BBC Safety, in conjunction with external bodies as appropriate, shall maintain the register on a quarterly basis to ensure that it includes all the UK and EU legal obligations pertinent to the BBC.
 
This will include:
 
A quarterly literature review will be conducted to maintain awareness of all applicable legislative, regulatory and other policy obligations affecting the BBC's operations at all geographical locations within the UK: i.e. England, Wales, Scotland and Northern Ireland, as well as European environmental legislation which is, or will be required to be, transposed into UK law.
 
This information shall be gained from the following information sources (generally websites).  For example:
  • Environment Agency (EA) and 'Netregs';
  • Scottish Environment Protection Agency (SEPA);
  • Environment and Heritage Service (Northern Ireland);
  • Institute of Environmental Management and Assessment (IEMA) bulletins;
  • ENDS Report;
  • Health and Safety Executive (HSE);
  • European Environment Bureau.
Information may also be derived from the following additional sources if necessary:
  • Codes of practice;
  • Best practice guidance;
  • International agreements (protocols not codified in law);
  • Voluntary agreements with regulators;
  • Specific requirements of Licences,;
  • Permits and Consents;
  • International standards (ISO standards etc).
All UK and EU legislation of relevance (direct or indirect) will be included in the register. 
 
Upcoming legislation will generally be recorded up to 6 months in advance, and will also be raised through the 'EU legislation' section on each page, which will generally highlight forthcoming UK legislation for 1-2 years.
 
Amendments to existing legislation will be incorporated into the existing entry 'row' summarising the legislation, but all changes will be highlighted and the date of amendment will be noted (denoted as 'as amended 2006', for example, under the Primary Legislation heading).
 
In the event that there are no amendments or modifications within the 3 month period, the documents will be formally reviewed and the review recorded.
 
All information shall be presented by means of a spreadsheet supplied covering the following headings:
  • Primary Legislation (full name including year of implementation);
  • Summary of Legislation (brief summary of the aims and objectives of the legislation, generally derived from the Explanatory Notes provided by the legislator);
  • Main Compliance Requirements (key actions/requirements are determined from a combination of the legislation itself, published guidance notes, information from the regulator and staff knowledge/experience);
  • Rating (full details of ratings contained on front sheet of register);
  • Activity (which BBC departments the legislation will be applicable to (see Scope));
  • Regulator;
  • Related Legislation;
  • Where to Get Further Information (sources of additional information if required);
  • Added Since Previous (denote legislation added in the current update with a Y).
'Last Revision' date will be amended.
 
Information presented will be subject to quality review by BBC Safety.
 
BBC Safety will undertake a review and business impact analysis of any new or changing requirements.  BBC Safety should have a discussion with the update provider, 1 month before the release of the updated register.
