Packaging Waste Regulations

The Packaging Waste Regulations place legal requirements on all UK businesses that import, produce or supply packaged products. The regulations extend to merchandise that is given away as a prize or promotional item.
 
 
Thresholds for inclusion under the regulations
A Business is obligated under the regulations if it has an annual turnover of more than £2 million and handles more than 50 tons of packaging per year. This threshold applies to an entire group of companies and its subsidiaries and the figures are cumulative across the group.
 
In addition, the business must be involved in one of the following supply chain activities:
  • Manufacturing raw materials for packaging - raw material manufacturer;
  • Converting raw materials into packaging - converter;
  • Filling packaging (i.e. putting goods or products into packaging) - pack/filler;
  • Selling packaged goods to the final user (which can be other businesses or the public) - seller.
  • Importing packaging materials or packaged goods in to the UK.
How the regulations apply to the BBC
The BBC as a whole is obligated through BBC Worldwide which is a 100% owned subsidiary that exceeds the threshold limit through its commercial activities. Therefore any additional activities carried out by the BBC 'Group' (Home Service/ World Service) divisions are included under the group of companies regulation.
 
BBC 'Group' divisions are obligated when they give prizes or promotional items away to members of the public. This activity obligates the division (and the BBC as a whole) as a 'seller'.
 
Examples of how a seller obligation might apply to a division include prizes on a phone-in show, promotional t-shirts given out at a festival or a key ring or mug given away as part of a local radio road show.
