Definitions of WEEE and Producers / Distributors
Electrical and Electronic Equipment (EEE) is categorised as follows:
  • WEEE consists of all equipment that requires an electric current (mains electricity or batteries) or electromagnetic field to fulfil its primary function. This includes peripherals (e.g. keyboards, mice, connecting cables) and fluorescent tubes (including energy saving bulbs and sodium lights). For general advice or information contact Ask Al - Safety Advice Line.Where a product contains electrical components, but these do not fulfil its primary function (e.g. a soft toy with a 'voice', where the primary function is a toy and it can function without the voice box) it is not classed as WEEE.
  • Exempt from the Regulations: Equipment rated above 1000v AC or 1500v DC, conventional (incandescent) bulbs, large-scale industrial tools, infected medical products or equipment intended for specific security or military purposes.  Batteries (disposable and rechargeable) are not classed as WEEE, but be treated as hazardous waste and disposed or recycled appropriately.
The regulations apply to organizations that 'place' EEE on the UK market. This includes EEE that is given away as a gift or promotional item.  Organizations can either be:

Producers. A Division is a producer if:

  • It physically manufactures EEE for sale.
  • It rebrands another producer's equipment where it completely removes or obscures the original producer's logo, brand or manufacturing information.
  • It imports EEE from overseas and it is the first legal entity in the supply chain in the UK.
  • A producer must also follow the guidance for distributors if it sells directly to consumers (e.g. via the internet or mail order).
Distributors. A Division is a distributor if it buys EEE from a producer, an importer or another distributor and sells directly to the consumer.
